Moratorium Request On Non-Pay Cancellations: Illinois
Illinois has issued insurance Bulletin 2020-15 on June 8, 2020, titled Coverage Related to Business and Property Damage Losses, Including but not Limited to Those Arising Out of Vandalism and Looting, requesting insurance companies allow coverage to remain in effect for an Illinois insured residing in a county where a disaster has been declared due to vandalism and looting.
Bulletin 2020-15 contains pertinent details as follows:
- The impacted Illinois Counties are: Cook, Champaign, DuPage, Kane, Kendall, Lake, Macon, Madison, Peoria, Rock Island, Sangamon, Stephenson, Will, and Williamson.
- The bulletin applies to all lines of business, both personal and commercial.
- The moratorium applies to ALL cancellations and nonrenewals issued on or after June 8, 2020, and remains in effect until August 6, 2020
- The Bulletin also requests:
- That insurers should err on the side of the policyholder when paying claims as the result of riots, civil commotion, or vandalism from commercial policyholders who have been unable to make full premium payments during the time period associated with Executive Order 2020-10, dated March 20, 2020, which was related to the public health emergency COVID-19.
- That to the extent business interruption provision are included and operative under a policy, insurers should base payouts on business activity levels that eliminate the impact of COVID-19.
- Insurers should err on the side of the policyholder when considering the use of exclusions that may or may not be applicable.
